Abuja’s New Rent Bill (2026): The 12-Month Advance Cap Explained

If an Abuja landlord has ever asked you for two years’ rent before handing over the keys, this one is for you. The FCT Rent Regulation and Tenants’ Protection Bill, 2026, now before the House of Representatives, would stop landlords and agents demanding more than 12 months’ rent to grant or renew a tenancy, make written tenancy agreements compulsory, and let a new FCT authority order refunds within 30 days. On a ₦3,000,000 (~$2,170) flat, that’s one year upfront instead of ₦6,000,000 (~$4,330) for two. It is not law yet. (Figures at ₦1,385/$, October 2026.)

Here’s the honest context first. Abuja has been here before. In 2022 a Senate bill proposed capping advance rent at just three months for new tenants, then monthly payments. It got a public hearing, drew strong views on both sides, and we found no record of it ever passing. So read this new bill as a serious signal of where the law may go, not as a rule you can quote at your landlord tomorrow.

What does the FCT rent bill actually say?

The Abuja rent bill sets a 12-month ceiling on advance rent, blocks the usual workarounds, and creates a regulator with power to order refunds. It was sponsored by Reps Paul Nnamchi (Enugu East/Isi-Uzo) and Ahmed Doro (Bindawa/Mani), Daily Trust reported on 26 October 2026. These are the main provisions as reported:

ProvisionWhat it would mean for you
12-month cap on advance rentNo landlord, property manager or estate agent could demand more than 12 months’ rent as a condition for granting or renewing a tenancy
Anti-workaround clauseCompulsory service charges, side agreements or ‘artificial renewals’ used to squeeze out more than 12 months would also be banned
Voluntary longer paymentA tenant could still pay for more than 12 months, but only if the tenant starts it, with no pressure, and it is documented in writing
Written tenancy agreementMust be in place before or at the start of the tenancy, stating rent, payment schedule, duration, refundable deposits, extra charges and both sides’ obligations
New regulatorAn FCT Rent Regulation and Tenants’ Protection Authority to monitor compliance, investigate complaints and settle disputes
RefundsThe authority could order a landlord to refund unlawful rent within 30 days of serving its order

We have not seen the full text of the bill. The Daily Trust summary does not mention fines or prison terms for breaches, so we’re not quoting any. When the text is published we’ll add the penalty section here.

Is the 12-month cap law in Abuja now?

No. The bill has been introduced in the House of Representatives, and that is all. Because the FCT has no state assembly, its laws come from the National Assembly. A bill like this has to pass readings and committee work in the House, go through the Senate as well, and then get the President’s assent before anyone can enforce it.

Until then, advance rent in Abuja is mostly whatever the landlord and tenant agree. Housing advocates say the current FCT rules focus on recovering possession of premises and don’t really deal with rent-setting or advance payments. A September 2026 policy brief by the Heinrich Böll Stiftung and HipCity Innovation Centre called that gap a key reason for excessive advance demands, according to the same Daily Trust report.

Watch out: don’t refuse to pay or withhold rent because you’ve read about this bill. Today it gives you no legal protection. Use it as a talking point in a polite negotiation, not as a weapon.

How does Abuja’s bill compare with Lagos?

Lagos already has a cap in law and a stricter one on the way. Abuja has neither yet. Here’s how the rules line up as of October 2026.

What would change for Abuja tenants?

Mostly, the size of the cheque you need to move in. Look, a year’s rent is still a lot of money, but finding one year is a very different problem from finding two. If the bill passes as reported, four things change:

  • One year maximum, new or renewing. The cap covers renewals too, so a landlord couldn’t hold your renewal hostage for a two-year payment.
  • No ‘service charge’ trick. Compulsory extras designed to push the upfront total past 12 months would count as breaches.
  • Paper first. A written agreement listing rent, deposits and every extra charge becomes the default, not a favour.
  • Somewhere to complain. Instead of going straight to court, you could take a complaint to the new authority and ask for a refund order.

What most coverage of the bill leaves out

It caps the advance, not the rent. Nothing in the reported provisions limits how much rent can rise. A landlord could still ask for a bigger yearly figure. In October 2025 the House adopted a motion, sponsored by Bassey Akiba, urging that yearly rent increases be capped at 20%, but a motion is a request, not a law, and that idea doesn’t appear in this bill’s summary. Back in 2022, Abuja lawyer Ephraim Akamihe made the same point about the Senate bill: shortening the advance without touching the amount won’t fix high rent on its own.

The ‘voluntary’ clause will be tested. In a tight market, some landlords will simply prefer the tenant who ‘offers’ two years. The bill only protects a longer payment if there’s no coercion and it’s in writing, so if you’re ever pushed, keep the messages.

No word on agency fees. Lagos’s bill proposes capping agents’ commission at 5% of annual rent. The Abuja bill’s summary doesn’t mention agency or legal fees at all.

A regulator only works if it’s funded. Lagos has had a one-year cap since 2011 and it’s widely ignored. Whether Abuja’s version bites will depend on whether the new authority gets staff, money and teeth.

What Abuja landlords and diaspora owners should do now

Plan for one-year rent as the norm. If your numbers only work because a tenant pays two years upfront, they don’t really work. Re-run your cashflow on annual payments, budget for professional management if you’re abroad, and have a lawyer draw up proper written agreements now (only a lawyer should prepare tenancy agreements). And check the land itself: if your plot’s ground rent is unpaid, the FCTA can revoke it, which is a far bigger risk to your rental income than any rent cap. Our guide to Abuja land revocation and ground rent shows what to check.

What should Abuja tenants do this week?

Get your current tenancy in writing, keep a receipt for every payment, and ask for any renewal increase in writing before your term ends. Timing matters too: the Housing Development Advocacy Network expects Abuja rents in established districts to stay under pressure through December 2026, with more people moving to satellite towns, as we covered in our rent-versus-wages update. If your renewal is due before January, start the conversation early.

And if a year’s rent is starting to look like a down payment, it might be. Our guide to the best areas to buy land in Abuja shows where plots still make sense, and the Minister’s Consent guide explains the paperwork that makes an Abuja purchase yours.

Frequently asked questions

Is it illegal for Abuja landlords to collect two years’ rent now?

No, not yet. The FCT Rent Regulation and Tenants’ Protection Bill, 2026 would cap advance rent at 12 months, but it has only been introduced. Until it passes both chambers and gets presidential assent, advance rent in Abuja is set by agreement.

When will the Abuja rent bill become law?

There’s no date. It must clear the House and the Senate and be signed by the President. A 2022 Senate bill with a three-month cap stalled after its public hearing, so don’t assume this one will move fast.

Can I still choose to pay two years’ rent in Abuja?

Under the bill, yes, if you start the arrangement yourself, without pressure, and it’s recorded in writing. A landlord or agent couldn’t make it a condition of giving you the flat.

Does the bill limit how much my rent can go up?

Not according to the reported provisions. It limits how much you pay upfront, not the rent level. A 2025 House motion urged a 20% cap on yearly increases, but that isn’t in this bill’s summary and a motion isn’t law.

Does the bill apply in Lagos or other states?

No, only the Federal Capital Territory. Lagos has its own 2011 Tenancy Law, which already caps advance rent from new tenants at one year, plus a 2026 bill that would tighten it.
